1. Geltungsbereich Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge und Leistungen, die zwischen LUMETRI MEDIA und ihren Kunden über jegliche Kommunikationskanäle (wie E-Mail, WhatsApp, Instagram, Website-Kontaktformulare und persönliche Treffen) zustande kommen, insbesondere für Beratungsleistungen und die Durchführung von Medienprojekten.
2. Vertragsabschluss Ein Vertrag kommt zustande, wenn ein Kunde unsere Dienstleistungen über einen der genannten Kommunikationskanäle beauftragt. Die Bestätigung der Beauftragung kann mündlich, schriftlich oder elektronisch erfolgen. Details zur Leistungserbringung werden, sofern erforderlich, in einem separaten Projektvertrag oder über eine schriftliche Vereinbarung festgelegt.
3. Leistungserbringung LUMETRI MEDIA beginnt mit der Ausführung der vereinbarten Dienstleistungen nach offizieller Auftragsbestätigung durch den Kunden. Starttermine und Fristen für die Leistungserbringung werden individuell und in Abhängigkeit vom vereinbarten Umfang festgelegt.
4. Preise und Zahlungsbedingungen Die Preise für die Dienstleistungen von LUMETRI MEDIA sind in der aktuellen Preisliste festgelegt, die als PDF auf unserer Website verlinkt ist und auf Anfrage auch über andere Kommunikationskanäle zur Verfügung gestellt wird. Sofern nicht anders vereinbart, erfolgt die Abrechnung unserer Leistungen nach dieser Preisliste. Rechnungen sind innerhalb von 14 Tagen nach Rechnungsdatum ohne Abzug zahlbar.
5. Urheberrechte und Inhalte Sämtliche im Rahmen der Projekte erstellten Inhalte, einschließlich, aber nicht beschränkt auf Texte, Bilder, Grafiken und Videos, bleiben Eigentum von LUMETRI MEDIA, sofern nicht eine ausdrückliche anderslautende Vereinbarung über die Rechteübertragung getroffen wurde. Der Kunde erwirbt an den Inhalten die für den vereinbarten Zweck notwendigen Nutzungsrechte. Eine weitergehende Nutzung bedarf der vorherigen schriftlichen Zustimmung von LUMETRI MEDIA.
6. Haftung LUMETRI MEDIA haftet nicht für indirekte Schäden, einschließlich entgangener Gewinne oder Folgeschäden, die aus der Nutzung oder Nichtnutzung der Dienste oder Inhalte entstehen. Unsere Haftung beschränkt sich auf Vorsatz und grobe Fahrlässigkeit.
7. Gerichtsstand Für alle Streitigkeiten aus diesem Vertragsverhältnis ist der Gerichtsstand Larnaca, Zypern.
8. Schlussbestimmungen Änderungen oder Ergänzungen dieser AGB bedürfen der Schriftform. Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, berührt dies nicht die Wirksamkeit der übrigen Bestimmungen.
Terms and Conditions of LUMETRI MEDIA
1. Scope These Terms and Conditions apply to all contracts and services concluded between LUMETRI MEDIA and its clients via any communication channels (such as email, WhatsApp, Instagram, website contact forms, and personal meetings), particularly for consultancy services and the execution of media projects.
2. Conclusion of Contract A contract is concluded when a client commissions our services through any of the aforementioned communication channels. Confirmation of the commission may be oral, written, or electronic. Details of the service provision are specified in a separate project contract or written agreement as necessary.
3. Service Provision LUMETRI MEDIA begins the execution of the agreed services following official confirmation of the order by the client. Start dates and deadlines for the service provision are set individually and depend on the agreed scope.
4. Prices and Payment Terms The prices for the services provided by LUMETRI MEDIA are set in the current price list, linked as a PDF on our website and available upon request through other communication channels. Unless otherwise agreed, billing for our services will follow this price list. Invoices are payable within 14 days of the invoice date without deduction.
5. Copyrights and Content All content created during the projects, including but not limited to texts, images, graphics, and videos, remains the property of LUMETRI MEDIA, unless an explicit agreement regarding the transfer of rights has been made. The client acquires the necessary usage rights to the content for the agreed purpose. Any further use requires prior written consent from LUMETRI MEDIA.
6. Liability LUMETRI MEDIA is not liable for indirect damages, including lost profits or consequential damages, arising from the use or non-use of the services or content. Our liability is limited to intent and gross negligence.
7. Jurisdiction For all disputes arising from this contractual relationship, the jurisdiction shall be Larnaca, Cyprus.
8. Final Provisions Modifications or amendments to these Terms and Conditions require written form. If individual provisions of these Terms and Conditions become ineffective or are, this does not affect the validity of the remaining provisions.
